Introduction

These Terms and Conditions govern your use of the Daily Word iOS app (the “App”). By using the App, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, you should not use the App.

Usage License

Daily Word grants you a personal, non-exclusive, non-transferable, and revocable license to use the App for your personal, non-commercial use. You agree not to use the App for any commercial or illegal purposes.

Ownership

The App and its content, including, but not limited to, text, software, graphics, photos, and videos, are owned by Daily Word or its licensors and are protected by copyright and other intellectual property laws. You agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, sell, or otherwise use any content from the App for any commercial or unauthorized purposes.

Modifications to the App

Daily Word reserves the right to modify or discontinue the App, or any portion thereof, at any time and without notice. Daily Word will not be liable to you or any third party for any such modification, suspension, or discontinuance.

Termination

Daily Word may terminate your license to use the App at any time and without notice if you breach these Terms and Conditions. Upon termination, you must immediately stop using the App and delete it from your device.

Disclaimer of Warranties

THE APP AND ITS CONTENT ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. DAILY WORD DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

DAILY WORD WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFITS OR CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, OR OTHER INDIRECT DAMAGES ARISING OUT OF YOUR USE OF THE APP, EVEN IF DAILY WORD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Governing Law

These Terms and Conditions will be governed by and construed in accordance with the laws of the state of California, without giving effect to any principles of conflicts of law. Any disputes arising under or in connection with these Terms and Conditions will be resolved exclusively in the state or federal courts located in Santa Clara County, California.
